What Is a Bail Bond?

Most people have heard the term bail bond, but don’t really have a good idea of what it is. They hear it get tossed around on their favorite legal drama, but beyond that, they don’t have a lot of experience with it. However, if you require one, it is important you know exactly what it is and how it works.

A bail bond has two parts: the posting of the bail money and the bond. Posting bail means providing the money the legal system is asking for to guarantee the release of the individual in custody. The bond is an assurance that the person who was arrested will show up at any future court dates; if they do not show, they lose the bail money and a warrant will be issued for their arrest.

Bail is set either when the individual is booked into the system or at a court date. In some cases, bail can be denied. However, even when bail is permitted—which is true in most cases—it doesn’t mean it is easy to get out of custody. In many cases, bail is simply too high to afford outright. Bail bonds allow individuals who do not have cash on hand to get out of custody quickly.

The San Bernardino Department of Corrections Can Be Tricky

Barstow is home to just over 20,000 residents, which means it isn’t large enough to justify having a detention center. Instead, individuals arrested in Barstow are held at the Barstow Sheriff’s Department directly after booking. The holding area at the station does not have the amenities needed to hold inmates for an extended period of time; as such, inmates are never held for more than a few days, and most are moved to a larger detention center within hours.

While having more amenities might sound nice, we assure you it isn’t. Essentially, all it means is having a designated eating space and access to a shower. And way more inmates to share it all with. Plus, once you are at a larger detention facility, processing times slow down significantly. This means that the inmate will remain in custody for hours, and even days, longer than needed. Paying for Your Bail Bond

If you cannot afford to pay your bail outright, a bail bond is the only other option for you. With a bail bond, rather than paying the full amount of bail, you pay 10% of the cost of bail to the bail bondsman. This 10% fee is fixed throughout the State of California and is set by the California Department of Insurance.

There are cases where you can pay 8% instead of 10%, but you can never be asked to pay more than 10%. If you run into a bondsman who asks for more, you can report them to the California Department of Insurance and should immediately seek out the help of another bondsman. The criteria for paying just 8% of the bond is below, and you only need to meet one of the items on the list to qualify.

  •         The arrested party has retained a private criminal defense attorney.
  •         A party to the transaction is a member of a workers’ union.
  •         A party to the transaction is a veteran or active member of the United States Military.

If bond is very high, you and your loved ones may not be able to afford even the 10% or 8% that the bail bond costs.
