What Is a Bail Bond?

In the United States, most individuals who are arrested are given a chance to post bail. Bail is used to get individuals who have been arrested out of jail before their case goes through the judicial system. If the individual, or their loved ones, can pay the full amount of their bail directly to the court, they can be bailed out without the services of a bail bonds service. Generally, the bail is returned when the person shows up in court. If they fail to appear in court, the court keeps the bail and issues an arrest warrant.

Basically, a bail bond is given to the court in return for a promise that the individual will appear in court when ordered to do so. A percentage of the bail, rather than the full amount, is posted by the bail bonds service. The bail bond serves as a contract between the arrestee, the court, and the bail bonds service. In exchange for the services, the arrestee pays the bail bond service a percentage of the total bail. If the accused fails to appear at their scheduled court date, the bonds service must pay the full amount of the bail to the court and issue an arrest warrant.

How is Bail Set?

Bail is set depending on the severity of the alleged crime. If the individual has been arrested for a less severe crime, the jail may use a standard bail amount to set bail right away, and the amount is generally small. In some cases, individuals are required to see a judge before bail is set and must wait in jail until a court date is set, and the bail amount is large.

Bail Bond Fee

By using a bail bonds service, the individual can get out of jail by paying a percentage of the bail instead of the entire bail. This fee is nonrefundable, and it is set to 10% by the state of California. This amount cannot be increased, but it can be lower under certain circumstances. If the individual meets any of the following criteria, they are eligible for a lower rate of 8%:

  • The arrested party has retained a private criminal defense attorney.
  • A party to the transaction is a member of a workers’ union.
  • A party to the transaction is a veteran or current member of the United States Military.

Ventura County Department of Corrections Facilities

When individuals are arrested in Ventura County, they are held at either the Pre-trial Detention Facility, or the East Valley booking facility. The Pre-trial Detention Facility holds individuals arrested in Ventura County by every law enforcement agency in Ventura County. The East Valley booking facility is at the East County Jail Facility, located at the Ventura County East County Sheriff Patrol Station, and holds individuals held in custody by the Ventura County Sheriff.
